1. Who we are
CaptainEnglish AI ("CaptainEnglish", "we", "us") is operated by Angelo Macajou ("the seller"). By using the service you are entering into an agreement with the seller. Contact: info@teacherangelo.com.
2. Acceptance
By creating an account or using CaptainEnglish, you agree to these Terms. If you do not agree, do not use the service.
3. The service
CaptainEnglish provides an AI-powered English speaking coach. Conversations are generated by large language models and may contain inaccuracies. The service is provided for general learning and is not a substitute for professional language certification, legal, medical, financial, or other regulated advice.
4. Account
You must provide accurate information, keep your credentials confidential, and be responsible for activity under your account. You must be at least 13 years old (or the minimum age in your country) and have authority to bind your organisation if signing up on its behalf.
5. Acceptable use
You must not use the service to: break the law; send spam or fraudulent content; infringe intellectual property; generate hateful, harassing, sexual content involving minors, or content that facilitates real-world harm; reverse engineer, scrape, or probe the service; jailbreak or circumvent safety filters; or resell access without our permission.
6. AI content
You are responsible for the prompts you send and how you use the output. AI output may be inaccurate; verify before relying on it for important decisions. You retain rights to your inputs. We may use anonymised, aggregated usage data to improve the service. We may remove or restrict content and outputs, refuse generations, and suspend accounts that repeatedly violate these Terms.
7. Intellectual property
The CaptainEnglish service, software, branding, and documentation are owned by the seller and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service within your active plan.
8. Payments & subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations and refund mechanics are governed by the Paddle Checkout Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled.
9. Cancellations & refunds
You may cancel at any time from the billing portal. Cancellation takes effect at the end of the current billing period. Refund eligibility is governed by our Refund Policy.
10. Service availability
We work to keep the service running, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features at any time.
11. Warranties & liability
To the maximum extent permitted by law, the service is provided "as is" with no implied warranties of merchantability, fitness for purpose, or non-infringement. Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or punitive damages including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where required by law.
12. Indemnity
You will indemnify the seller against claims arising from your content, unlawful use of the service, or breach of these Terms.
13. Suspension & termination
We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your access ends; you may export your data within 30 days, after which it may be deleted.
14. Changes
We may update these Terms. Material changes will be announced in-app or by email. Continued use after the change is acceptance of the new Terms.
15. Governing law
These Terms are governed by the laws of the seller's jurisdiction. Disputes will be resolved in the courts of that jurisdiction unless mandatory consumer law states otherwise.
